Eliza's television is destroyed and can be replaced at the Appliance Warehouse for $1,250. The loss adjuster, Piero, makes her an offer of $700 because the policy is subject to a $500 deductible and the depreciation is $50.

Eliza responds, "Your offer is too low. I'll settle right now for $1,000." It might be tempting for Piero to close the file, but the deductible is not negotiable under these circumstances. In this situation, the only negotiable item is the amount of depreciation that was assessed. (And if Eliza's policy includes replacement cost, then depreciation does not apply.)
