The ADEA prohibits discrimination against employees ages 40 and over (employees ages 39 and under may not file a claim for age discrimination). When companies eliminate jobs, employees ages 40 and over are often impacted at a higher percentage, since middle managers tend to be over 40 years of age.

An employer may lay off employees ages 40 and over, even in a disproportionate amount, as long as the company can show that the decision was based on reasonable factors other than age.
