Module introduction
Aim: This module aims to facilitate a critical appreciation of social policy and mental health law as it applies to practice, enabling appropriate application to mental health arenas taking into account the potential for power imbalances and ethical/ legal dilemmas
Learning outcome 1: Evaluate the implementation of social policy in particular areas of mental health practice, including community and other care settings
Learning outcome 2: Analyse the legal and ethical dilemmas which may present for the non-traditional service provider when applying social policies in practice
Learning outcome 3: Demonstrate an understanding of the societal and historical contexts in which mental health law and policy is developed
Learning outcome 4: Explore the potential for power imbalance in mental health practice and the consequences at an individual and community level
Assessment brief
Students are required to submit a written analysis of an aspect/ element of current law or policy, examining the ethical implications of law and policy directives upon mental health practice
Content and structure
• Establish how you plan to address the brief, clearly identifying the key issues you intend to explore.
• You should first briefly discuss the historical and socio-political context of your chosen area of law or policy
• Evaluate the implementation and impact of your chosen law/ social policy with particular reference to non-traditional models of service provision such as the third or private sector
• Legal and/ or ethical dilemmas and the potential for power imbalances.
• Summarise the significant points you have raised throughout the main body and draw your key themes together to form a cohesive illustration of your arguments.
Please note that at this level of study you must take a more independent approach to interpreting the assessment brief, and determining the content and structure of your work. There are many ways in which an assessment brief can be answered, and demonstrating critical thinking and independent thought are important at Level 5.
