Question

With reference to the Hire-Purchase Act 1967, discuss the legal position in the following situations: 

(a) Fiza entered into a hire-purchase agreement with Go Buy Finance for the purchase of an electrical sewing machine. Fiza has to pay a monthly instalment of RM150 for 3 years beginning from January 2022. In May 2022, Fiza was involved in an accident and passed away. Fiza is survived by her husband Sulaiman and their two children. An employee from Go Buy Finance informed Sulaiman that the hire-purchase agreement made by Fiza has been automatically terminated by her death. The employee then proceeded to take the sewing machine to be returned to Go Buy Finance. 

(b) Chua Ming entered into a hire-purchase agreement with Alpha Finance for a refrigerator. He later decided to assign the hire-purchase agreement to his neighbour Hayati. Chua Ming informed Alpha Finance about this and was told that he must pay a consent fee of RM300 and another RM500 to arrange the paperwork for the assignment of the refrigerator to Hayati.
