Question
Kevin contacts Alex, a seller of technology. The technology is divided into several tiers. Tier 5 is the highest grade and most expensive technology. From there down to Tier 1 the technology is less costly but less precise.
Following discussions, Kevin and Alex agree that:
"Kevin will buy from Alex and Alex will sell to Kevin Alex's technology of a Tier suitable for Kevin's needs."
Two months later, Kevin reads from industry publications that Alex's technology, being still in its infancy, may be unreliable. Kevin tells Alex that it wilt not go ahead with buying Alex's tech, When Alex protests, Kevin says that their agreement was not contractually binding as it was too uncertain.
