Prusia, Inc. has been in business for several years. The company thinks that it needs to downsize some of its higher paying management positions by forcing early retirement. To avoid a discrimination suit under the ADEA, Prusia decides to have the employees sign a waiver of age discrimination claims. Peter, one of the higher paid managers, decided to sign the waiver and retire. He was told that he could revoke his decision to retire, but it would be an easier process if both parties could simply agree that he would not revoke his decision to retire, which would also make the process quicker for him to receive any monies due to his signing the waiver. Peter agreed that he would not revoke his decision. Has the employer done anything in violation of the Older Workers Benefit Program Act (OWBPA) in its dealings with Peter in this instance? Briefly explain your answer.
