Dana, a female, alleged discrimination in hiring when she applied for a job as a heavy equipment operator with Highway Construction, Inc. Shaft, the foreman and person responsible for hiring heavy equipment operators for the corporation, told Dana he would never hire a woman to do a man’s job, even if she were qualified. Dana, sued Mable, the sole shareholder of the company and the president. Mable argued he was not personally responsible for Shaft’s actions or those of Highway Construction, Inc.
