Question: Possession of a drug or another illegal controlled substance occurs only when a defendant is knowingly in possession of the substance. According to Justia (2023) there are two elements that must be met for the crime of possession. Those are "The individual must have known that they were in possession of the drug" and "The individual must have known that the drug was illegal" (Justia, 2023). So, although it was legal where Nigel was from it was illegal where he traveled, and he knew that. Therefore, he was in possession of the illegal drug and knew it was illegal. So according to the law yes, he would be guilty of the crime of possession.
