Question 1
The Federal Communication Commission (FCC) has the authority to regulate the internet. After gathering information and reviewing data and hearing from experts it has announced in Decmber 2017 that it will void the "net neutrality" FCC regulations put in place during the Obama Administration. Do research on this issue called "net neutrality" on the internet to understand the arguments for/against this action. Many business and individuals are upset about this new administrative action because it was rapidly done and there are allegations of "fake" comments posted to the FCC website during the notice/comment period by stolen identities (as if they were public comments in support of
the FCC's move to end "net neutraility" but were fake persons posting these comments).
How can those with "legal standing" fight back against the FCC's decision to void the "net neutrality" regulations by using the three branches of the federal government and how these three branches have general controls over agencies, albeit indirectly at times. Explain. (Hint-- at least two online video lectures this term explain the controls/checks on the three branches of the federal government has over federal agencies)
Question 2
Using the steps in the "design approach" described in your Text: "The Responsible Administrator: An Approach to Ethics for the Administrative Role" -6.Edition- 2012 to develop an appropriate response to the below ethical dilemma:
About 25 +/- individual States in the USA have passed State laws allowing for medicinal use of marijuana. The State laws require a doctor's prescription and tight regulatory controls, registration requirements, licenses, inspections and reviews of the business, doctors and patients involved to avoid any mis-use of this drug. Do research on this issue to brief yourself on the pros/cons of this issue.
You are an assistant US attorney general in the US Department of Justice (a federal agency). The Attorney General of the United States has ordered you to start to prosecute ANYONE (doctors, business owners, patients etc...) who have in their possession, use or even issue prescriptions for medical marijuana under state laws (since it is still a "schedule 1" drug under federal law and thus illegal even if the individual states have legalized medicinal use of marijuana.). Many people will now suffer (along with individual state's economies because they lose the tax dollars).
Further, sick individuals will have to resort to addictive pain medication (opioids) which are killing over 68,000 people a year through addiction and mis-use. Finally, sick individuals will resort to the "black market" for marijuana anyway and buy it illegally off the streets. The big drug companies however, are very, very happy because their expensive pain medications will have to be used more often now as they are the only legal prescriptions available to fight the pain facing many sick individuals (ie. no more medical marijuana).
You now need to address this issue on a moral level. You have to decide if you will follow Jeff Session's order (your boss) to prosecute all medical marijuana users and/or doctors or involved businesses or not.
A) Explain your answer using the steps in the design approach and itemize each of these elements and apply them to these facts. Give an ultimate moral decision that you will follow to justify your actions.
