Question

On 2 June 2024, Randy was on his way to record a music video for MTV. As per his agreement with MTV, upon the successful recording (or "shoot") of the music video, Randy would immediately receive R50-000.00 (fifty-thousand-Rand) compensation. On his way to the "shoot", Peter crashes into Randy's motor vehicle. Randy's car is damaged as a result of the crash. The damage to Randy's car is R100-000.00 (onehundred-thousand-Rand). You hear from Peter's legal representative (Carl Mayberry) who intends to settle the matter outside of court. Carl Mayberry admits that a delict has taken place. In addition hereto, Carl Mayberry alleges the following: As a general rule the patrimonial delictual damage suffered by Randy is the difference between Randy's patrimony before and after the commission of the delict. Explain to Randy the merits of Carl Mayberry's argument.
