Melanie Ashton worked as a cashier at King Foods, a general partnership. She had just left her assigned check-out lane to use the public Ladies' Room at the back of the store. Melanie apparently entered the bathroom at a brisk pace; a customer (Amy King) already in the bathroom but trying to leave was hit by the opening door; she fell to the floor and sustained serious injuries.

Ms. King subsequently sued King Foods, arguing that the company was liable for the negligence of its employee, Melanie.
