A firm acquires a new client who wants a divorce from her husband. The client is still currently living with her husband and has not yet told him she wants a divorce. The client knows that establishing a date of separation is significant for family law purposes, but she cannot afford to move out of the family residence at this time. However, she is ready to proceed with initiating the divorce and wants to know if moving out of the family residence is required. Draft a memo as a paralegal to your team addressing this issue.
