If a fire investigator negligently knocks over a gasoline can which results in a fire that causes injury, they would likely be found liable and so would their organization. The determination is most easily made by reconciling the employees breach of duty. The fire investigator would fit the scope of this finding because it is based upon how a reasonable person, with similar training would act in a similar circumstance. The second part is a finding of factual causation and those dots are rather simple to connect: The injuries were caused by the fire, and the fire was caused by the carelessness of the investigator (Beatty, Samuelson & Bredesco, 2013). The likely outcome for the organization, which is held liable through the acts of the employee working within the purview of their occupation, is a fine. Beatty, Samuelson, and Bredesco (2013) describe a 2005 case that killed 15 people at the hands of British Petroleum after failing to ensure safe practices resulted in a significant fine. Ignoring safety standards, is an intentionally costly enterprise for organizations when there are failures. Issuing fines to organizations for the negligence of their employees is an effective and proven way to minimizing future occurrences (Foley, 2011).
