Edith and Mary, who are sisters, are trainee solicitors in London. Since they were unable to find suitable and affordable accommodation, their parents, Robert and Cora, decid ed to sell the property to which they had retired and pool the proceeds of sale with the money which Edith and Mary had saved in order to buy Downton House for them all to live in. Downton House, title to which is registered, was transferred in to the names of Edith and Mary as legal and equitable joint tenants. No restriction was placed on the register to protect any interest of Robert and Cora. All four moved into Downton House. Discuss EACH of the following ALTERNATIVE situations -
(a) Edith and Mary find living with their parents increasingly tiresome; and they tell Robert and Cora to leave.
(b) Edith marries Bertie, who moves into Downton House. Mary dislikes Bertie and decides to move out of Downton House. She sends a text message to Edith, Robert and Cora stating, "I shall want my share of the house when it is sold." Edith replies to all of them, "Bertie has just inherited some money which he says I can use to buy you out." One month later Mary is killed in an accident and she leaves all her property in her will to her boyfriend, Henry.
(c) Mary decides to emigrate to Australia. She wishes to sell Downton House and realise her share of the proceeds. However, Edith is settled in London and wishes to remain in Downton House, as do Robert and Cora, who cannot face the upheaval of another move.
(d) Edith and Mary decide to emigrate to Australia and, when Robert and Cora are on an extended holiday, sell Downton House to Tom.
