Felix is renting a small house from Oscar. Shortly after moving in Felix noticed that there was a leaking pipe in the kitchen area. Felix notified Oscar about the problem right away. Oscar said he would get it fixed, but a month later the pipe had still not been repaired. When Felix delivered the monthly rent check to Oscar, he again reminded him about the leaky pipe and warned Oscar it was getting worse. Oscar again promised to have it fixed, but again no repairs. A week later the pipe burst and began to leak all over the expensive baseball cards that Felix sells online. Although Felix could have moved the cards, he did not, as Oscar had been given fair warning. The entire collection, with a fair market value of $5,000, was ruined. Felix (P) claims Oscar (D) owes him $5,000, the full fair market value of the damaged cards.
