Pick a federal agency and draft a Freedom of Information Act (FOIA) request for information from that agency. The FOIA request must meet all of the requirements under FOIA and under the agency's statutes and regulations.
1. Review Sections 5 U.S.C. § 552(a)(3)-(4) of the FOIA for some of the requirements for FOIA requests. Note that the FOIA requires the request to "reasonably describe" the records sought and to comply with the agency's FOIA request requirements. Also note that a particular format can be requested.
2. Review Section 5 U.S.C. § 552(b) of FOIA for the nine categories of records that are exempt from the FOIA's production requirements.
3. Choose a federal agency that you want to send a FOIA request. Review the agency's website for explanations of the process. Review any relevant statutes or rules/regulations that apply to the agency's FOIA requests.
4. Explain the information that you found in Step 3 and what must be included in a FOIA request for the agency.
5. Draft a FOIA request for the agency that complies with FOIA, the agency's FOIA request requirements, and requests documents that are not exempt from disclosure under 5 U.S.C. § 552(b).
6. Submit as your assignment: 1) your brief explanation in response to Step 4; 2) your FOIA request in Step 5; and 3) an analysis that explains why the documents you requested are not exempt from disclosure.
