Responsible Climate Protest
19. The objects of this Part are to ensure:
The right to assemble and express views regarding climate change in a respectful manner which does not impose itself upon those availing themselves of shared public space.
That vulnerable businesses are not victims of targeted protest actions aimed solely at the discomforting customers by effectively blockading business premises.
Disruptive Protests directed at customers, businesses etc
20(1) Individuals engaging in protest actions at, or outside, listed business premises must not engage in disorderly conduct which is likely to prevent or significantly disrupt the carrying out of business activity at the premises.
20(2) Disorderly conduct includes any threats, insulting or demeaning material which, stepping beyond the bounds of fair-minded protest, vilifies those offering, contributing to or availing themselves of the list business' services.
20(3) Qualifying listed premises are contained in Schedule A to this Act.
Consequential orders and penalties
21(1) Orders and Penalties under this provision will be administered by Australian Charities and Non for Profits Commission.
21(2) Engaging in conduct prohibited under section 20 may result in a funding and charitable status review of any entity with which the individual is affiliated.
21(2) Individuals or entities sponsoring or platforming disruptive protests may be subjected to protest organisation barring order. This may render them ineligible from attending or promoting protest actions in the future.
