Question: Marcus, an African Canadian, was terminated from his job after working for Foot Locker for 22 years as an Assistant Manager. Marcus is upset about his termination and believes it may have been racially motivated. Marcus believes his Manager, Pauly, did not like him because he has an African-Canadian background. Marcus has no evidence that Pauly has philosophies of prejudice. In fact, Marcus has had limited interactions with Pauly during their time working together. Marcus went and received legal counsel from Martha Hart. Marcus was advised to sue Foot Locker for discrimination through the Ontario Human Rights Tribunal. Martha has advised Marcus that if this matter goes to mediation, she prefers to settle the matter instead of going to the Tribunal due to the 2 to 3-year wait for a hearing. Please explain why mediation could be the most effective approach to resolving his employment dispute in this essay. How can mediation be used in this case?
