Case: Hannah is an assistant booking agent on a network morning show. Mitch, one of the stars of the show, takes note of Hannah and arranges for her to be on the team traveling with him for a special segment. Once at their destination, Mitch befriends Hannah and invites her to his hotel suite to discuss the next day's show. They share a bottle of wine, and all of a sudden Hannah finds herself in Mitch's bedroom, where he proceeds to tell her he can help her with her career if she helps him with his (sexual) "needs." Hannah does not want to submit to Mitch, but she feels compelled to have sex with him because of his position with the network. When they return from the trip, Mitch tells Hannah that he has arranged for her to become the head booking agent. Although she is sickened by what happened, Hannah decides it would be better for her to focus on her new job and not dwell on the incident by reporting it to the Human Resources (HR) department. Six months later she changes her mind and sues the network after receiving a right-to-sue letter.
Question 1. Explain what type of case Hannah would bring against the network, what she would have to prove, and if the network would have any defenses.
Question 2. Explain what type of case Hannah would bring against the network if instead of submitting to Mitch, she fought him off and then finds out when she's back at the station that she's been demoted to production assistant (a job which primarily involves getting coffee and running people's personal errands). She complains to the HR department, which "loses" her complaint because Mitch makes so much money for the network. Note if the network would have any defenses.
