In response to BP's request that the refinery reassign Sheldon to a job without exposure to toxins or remove him, the contractor employing him laid him off. What elements would Sheldon need to prove that BP violated the Title I of the ADA and the Americans with Disabilities Act Amendment Act (ADAAA) of 2008? Are there any defenses available to BP under the Act?
