Case : Employee Termination
You are the Director of IT for Company XYZ (The Company). You have five managers reporting to you. Three are performing well but two are problematic and you need take action on both now.
The Company is an Employment at Will employer. Progressive Discipline is the approach used in the organization and Just Cause is used as the standard for termination.
Manager A on your team is just not a strong performer. He does not manage his team well; misses critical deadlines and is constantly over budget. He is a nice, well-meaning person but he is not producing the results or developing the team that you and the company need. You have been through Progressive Discipline with him and it is now time to terminate his employment with The Company.
You must now:
Identify and explain the steps you have taken with Progressive Discipline, beginning with setting performance/job expectations in January 2018, to this point. (You have followed through on all the steps.)
Justify termination is the appropriate Just Cause action based on the Progressive Discipline steps you have taken previously.
Detail how and when the termination will take place. (What you, as the manager, will say and do.)
Outline what will be offered to the employee at termination including Mandated and Legally Required Benefits. (Because this issue has been dealt with over several months and it is a performance issue, severance will not be offered.)
Manager B on your team has not been a performance problem from your perspective. In fact, he is one of the best technical performers on the team and always meets deadlines/stays within budget. But he can come across as abusive with his direct reports and with his internal customers.
You have had multiple complaints for several years but for various reasons you have never started the Progressive Discipline process with him. Last week he had a violent altercation with one of his direct reports. The entire team, and several customers, saw it. Everyone reported that the altercation was his fault; he was totally out of control and each of them felt threatened and unsafe. All have said they will not work with him again.
