Since the type of business conducted by ABC Computers (manufacturing and selling computer parts) is not federally regulated, ABC Computers is a provincially regulated company operating in Ontario and therefore Ontario's Employment Standards Act (the "ESA") sets out rules that applies to ABC Computers and its employees. One of the rules set out in the ESA is the lowest hourly wage that an employer can pay to an employee. This minimum wage must be paid to employees of ABC Computers unless there is a special rule or exception set out in the ESA that applies (such as if the employee is considered a "manager" under the statute.) The current minimum wage under the ESA is $16.55, and therefore, unless there is an applicable ESA special rule or exception, the wages of those employees of ABC Computers currently earning $10 per hour must be increased to $16.55 per hour. Note that most employees are covered by this minimum wage requirement, regardless of how they are paid or whether they are part-time or full-time.
