Assignment: Product Liability
Background: Partner Ava Kennedy has been hired to represent a plaintiff in a products liability claim. This case involves using strict tort liability as the basis for the claim. In preparation for this case, Partner Kennedy has asked you to create a PowerPoint presentation describing the elements necessary to support a strict liability/products liability case as well as any potential defenses that could be raised regarding this type of claim. She has informed you that you should be able to identify at least three potential defenses associated with this type of products liability case.
Instructions: Using the PowerPoint format, create a 9 to 13 slide presentation including all of the following information:
Identification of each of the general elements necessary to support a products liability claim utilizing the theory of strict liability. There are FIVE elements that should be identified in this section. Include a simple narrative example demonstrating an understanding of each of the five elements. (5 slides)
Your first potential defense to a products liability/strict liability claim. Be sure to sufficiently explain the factors that must be supported for utilization of this defense. Remember, examples are always very useful in demonstrating each concept. (1 -2 slides)
Your second potential defense to a products liability/strict liability claim. Be sure to sufficiently explain the factors that must be supported for utilization of this defense. Remember, examples are always very useful in demonstrating each concept. (1 -2 slides)
Your third potential defense to a products liability/strict liability claim. Be sure to sufficiently explain the factors that must be supported for utilization of this defense. Remember, examples are always very useful in demonstrating each concept. (1 -2 slides)
Identification of a judicial decision (case) that involves at least one of the defenses identified earlier in your presentation. This slide should be properly cited per the Bluebook and briefly describe the rule of law, or legal standard, used by the Court in addressing the applicable defense. (1 -2 slides)
Remember you are the "presenter" and, as such, you will be reading your Speaker Notes the same way you would a presentation paper. (The "narrative", which is a clear, complete explanation of the content and points you are making, goes in the Speaker Notes). The clent (audience) will be looking at the slides which should include highlights and illustrations of your comments for that slide. The slide content should align with the narrative in the Speaker Notes.
