Questions

Q 1. Administrative tribunals such as VCAT are hailed as the preferable dispute resolution option over court proceedings.

Compare and contrast the advantages and disadvantages of using administrative tribunals over courts and advise on which you believe is the preferable dispute resolution avenue.

Q 2. Children's Court needs to explain why teen granted bail over alleged police attack, Minister says Victorian Police Minister Lisa Neville has criticised a Children's Court over its decision to grant bail to a teenager who allegedly assaulted a police officer.

The 17-year-old was on parole at the time of the alleged attack at Highpoint Shopping Centre, in Melbourne's west, on Boxing Day. Ms Neville said the courts should have listened to police on the matter.

"They opposed strongly this person getting bail and the courts need to explain how on Earth they could make a decision so contrary to what police view was," she said.

She called on the courts to explain the decision.

"I respect the independence of the court, and it's a fundamental part of our democracy, but you want that independence, if you believe strongly in your decision making, it's incumbent on you to share that information," she said. "Just like I have to justify decisions I make, so too should the courts back to the community.

Q: 3. The Torrens System is the preferred method of title registration in Victoria. Discuss this statement.

Q: 4. A client is getting a new side fence and discovers that the old fence which is 17 years old is not in the correct place according to the title. Their fence line is misaligned with the title boundary (6 inches x 150 feet in total area) in their favour. The neighbours want it replaced and back to where it should be according to the title.

Your client has built a garage on the boundary and is requiring advise. They are concerned that the matter is getting ugly and it is affecting their relationship with their neighbour which is long standing.

You need to explain the relevant law and where they stand. Explain the difference between ownership and possession. (That is land defined by title versus land possessed.)

Also advise them who they need to engage before they make a claim or try and settle the matter.

You also need to advise them of any other possible solutions to solve this issue.

Students are advised that they are likely to be asked to personally demonstrate their assessment work to their teacher to ensure that the relevant competency standards are being met. Students will be provided with feedback throughout the course to check their progress. If deemed necessary students will be asked to recreate any part of their assignments at a prearranged time. On an individual basis the candidate will be required to successfully demonstrate how a specific outcome was delivered. Therefore although an assignment is to be completed in teams, team members must be knowledgeable on and familiar with ALL aspects of the assignments.

2. Following from point 1 above, where a student cannot be deemed competent via another task or assessment, they will be required to resit that task or the assessment in full in the final week of the semester, that being week 16. Please note that students only need to resubmit that part of the assignment deemed not yet competent. 3. Students who take more than one attempt to pass this assessment can only be given a (CAG) Competent upon passing from attempt two onwards.

The Grade below is for this assessment only. Students only receive a grade when this assessment has met the criteria for competency. When competency has not been achieved, students will receive either a DNS (Did Not Submit) for assessments not submitted or completed or an NYC (Not Yet Competent) where the assessment has been completed but not to the required level of competency. Important: 1. Any task where the minimum has not been met, the student will have the opportunity to be deemed competent in the same indicator, that being the required knowledge, skill and elements/performance criteria (where applicable) via another task or assessment.

This assessment is competency based and a CAG (competent) must be achieved for this assessment. The assessment will be graded (once competency is achieved) according to the grading policy for assessments those being, CAG (competent), CC (credit), CDI (Distinction) or CHD (High distinction). Your teacher will discuss the assessment matrix for each assessment with the class at the beginning of the semester and prior to the assessment taking place.
