Problem

After a series of fights in the Mall of America, the Mall of America contracts with the Safety Experts to install a state of the art security system. Per the contract, the Safety Experts agree to install a video and security system that will "monitor and record all activities public spaces in the mall." Two years later, a mall patron was mugged in the hallway to the bathroom. The victim was hospitalized for a week and had $5,000 in jewelry stolen. There were no functioning security cameras in the hallway to the bathroom. It was impossible to tell who was in the hallway because the security system recorded over videos every six hours (they were automatically deleted). Can the victim successfully suer the Safety Experts for breach of contract under a third party beneficiary theory? Explain you answer.
