The Employment Standards Act, 2000 is the statute that provides for a minimum floor of rights in the context of employment in Ontario; the statute regulates, among other things, minimum wage, overtime pay, minimum vacation entitlement and vacation pay, pay periods, and hours of work. Conversely, employers often view the regulation of employment as imposing burdensome requirement and "red tape". The Doorey text discusses, at length, the concept of an "efficient breach" and the real world implications for such a theoretical concept.

Explain the concept of an "efficient breach" using a minimum right contained in the Employment Standards Act, 2000 as an example? Discuss a situation from your own life or a person you know where an employer or company has engaged in an apparent or possible "efficient breach", what legal right was violated, assess why the employer possibly undertook that action, and what recourse was available and was it utilized.
