The term "public law" refers to the body of law that is formulated by governmental bodies in order to control the actions of private citizens and public institutions. It encompasses international law, administrative law, common law, and statutory law, in addition to constitutional law and statute law. Contracts, torts, and property law are examples of areas of private law that focus on the relationships between private parties.

The body of laws that defines and controls the rights and obligations of individuals as well as organizations is referred to as "substantive law." A federalist government is one in which authority is shared between a central government and one or more subnational governments, such as state or local governments. In the United States, the power to enact laws that are binding throughout the entire nation rests with the federal government. Examples of such laws are sales taxes and speed limits. The federal and state governments' respective authority structures are laid forth in the state constitutions as well as the United States Constitution.
