Question: To discourage jurors from engaging in case-related social media research or communication, a federal Judiciary committee has produced new model jury instructions. Federal courts may use these instructions. What constitutes appropriately obtained evidence is a topic that states have also codified. The potential impact of social media on a jury's objectivity is highlighted in these updated instructions. However, in both federal and state courts, it is becoming more difficult to manage the amount of information that a juror may view. Jurors' desire to discover "the truth" may lead them to disregard the Court's and the Constitution's orders and regulations about the correct collection of evidence.
