Question: Imagine you are a police detective in a rural area where outsiders rarely come to settle. A murder was committed in the Summer of 2013, and the only evidence you have to identify the murderer is a DNA profile from some skin that was found under the victim's fingernails. It is now 2014, and a defendant is on trial for the murder.

Imagine also that during the 1990s, the state had made the effort to collect a set of samples from people living in this region, and they have a good-sized database to provide the prosecutor with the frequencies of the STR alleles that are present in the people who live in the area. Imagine now that the defendant's family has only been in the region for a relatively short time. There are a significant number of them living in the region now, but the first ones to settle in this region moved into the region around 2004. Which attorney-the prosecutor or the defense-should challenge the validity of the database? Explain clearly why this attorney should claim that the database that is available now will produce a random match probability that is unfairly stacked against that attorney's attempt to either convict (if the prosecutor) or exonerate (if the defense) the defendant.
