Assignment:
Canadian Property Law Question.
Our client, Dr. Chuck, is a chemist who lives in Unit 3 of a 7-unit row of townhouses where all the units are connected and separated only by party walls between the units. He owns his townhouse. Chuck is experimenting in his basement with a new invention: a repellant spray to keep animals away from people's garbage cans and gardens. Unfortunately, his new invention smells like skunk spray, and it is very noticeable in all the other townhouses. Chuck's neighbours have complained to him about the smell and demanded that he stop his experiments. Chuck has come to our office to see whether he must stop experimenting at this stage of his brilliant invention, just before he appears on Dragon's Den in their upcoming two-part special on "Chemistry at Work in Canadian Business".
Explain to Chuck what his rights and responsibilities as the property owner might be in this situation.
