Scenario

Prospective buyers, Mr and Mrs Jones, visited an open home the licensee was running at a property he was marketing. In his discussions with them about the property, he learned their purchasing criteria including their preferred location, the number of bedrooms they required and their upper price limit.

The couple later told the licensee they were no longer interested in the property they had viewed and would continue looking for a suitable home.

The licensee had the idea to identify 40 properties that could meet the requirements of Mr and Mrs Jones. He did this and then delivered flyers to each residence identifying Mr and Mrs Jones by name and stating their upper price limit. Mr and Mrs Jones were not aware that the licensee was sending out the flyer.

When they found out, the couple laid a complaint against the conduct of the licensee.
