Case: Using the Statutory Accident Benefits Schedule, O. Reg. 34/10, (SABS) this is a regulation made under the Insurance Act.
Question 1. a)Can I please get assistance in determining which sections may apply to the client below.
b)Assuming the driver who caused the accident has automobile insurance, thus the SABS applies.
c)Are there any other assumptions you make in answering the questions.
A client has come into your office after an automobile accident for which she is not at fault. The injuries to her family are quite horrifying. Please prepare written advice to the client with respect to the type of claims she will be able to make based on your reading of the SABS. Details of the accident are as follows;
The driver is a 41 year old nurse, currently employed at the local hospital making $45,000.00 per year. She has lost an arm as a result of the accident, and her eyesight in her right eye, and is unlikely to be able to work again.
Her husband was in the passenger seat, he was an airline pilot making $70,000.00 per year. He died at the scene.
Her sixteen year old son was in the car with her. He has significant brain damage, and needs nursing care around the clock, possibly for the rest of his life, it is too soon to tell what, if any recovery he will make.
Her 67 year old mother was also in the car, she had a prosthetic leg, which was destroyed in the accident and must be replaced. She lives on Old Age Security as she is a widow. She is now paraplegic.
Question 2. Assist me in determining the possible claims, and making a preliminary assessment as to the amounts available with each claim (ie. Maximum amounts).
Question 3. Please help me to ensure you have noted any possible exclusions, if any apply.
Question 4. Help meProvide the client with some advice as to how to make the benefits claims.
Question 5. Please explain any responsibilities she may have with respect to getting her damages assessed or seeking any necessary treatment.
