TERM PAPER ASSIGNMENT
TERM PAPER: There is one 8-page (double-spaced) research/term paper assignment required for the course. This page requirement does not include cover page or reference page, which are required (or appendixes, etc., if you attach any).
Make sure you cite sources as you use them (do not just list them at the end of the paper. Learn how to properly cite/document sources). It is recommended that you start with an outline and use headings to break up the sections of your paper.
Your paper assignment has four components. You are to address each of the following questions about the U.S. and Nevada Constitutions (your paper is NOT to just do a comparison of the two constitutions):
(1) Explain the significance of the fact that the Nevada constitution is lengthier than the U.S. Constitution. Why is it lengthier and what does this mean for the Nevada judges as they do their jobs of interpreting the state constitution compared to federal judges?
(2) Compare how much power Nevada's governor has in the state political system compared to the president's power within the national system of government. Consider formal powers (veto, pardon, who they get to appoint or not, such as Secretary of State, judges, etc.).
(3) Explain how Nevada's legislature is constrained by Nevada's forms of direct democracy (i.e., the initiative, referendum, recall, and statute affirmation) and its constitutional mandate to meet only every other year for 120 days, etc.
(4) Explain the strengths and weaknesses of Nevada's system for electing judges compared to the so-called Merit Plan (i.e., "Missouri Plan", or similar plan) used in other states, as well as the U.S. national system for appointing judges. Describe recent attempts of Nevada to move to the merit plan. Also, outline Nevada's recent attempts to establish an intermediate court of appeals including its successful attempt in November 2014.
