Question: You are now a Justice on the US Supreme Court. You job is to evaluate the decision of the 5th Circuit Court of Appeals in the case of the City of Austin v. Reagan National Advertising. You will either agree with the lower court or overturn their decision.

The 5th Circuit determined that the law was not "content neutral" so strict scrutiny applied, which the law failed, so the law was Unconstitutional. An alternative approach would be to say that the law should be considered "content neutral" so intermediate scrutiny (or the very similar commercial speech Hudson Test) applied which the law would probably pass, making it Constitutional.

Read the lower court's decision, listen to the Supreme Court Oral Argument, and make your decision.

Your decision should be 3-5 single spaced pages that explains how your decision. If you are using case law, it is acceptable to simply cite to the decision. You may also cite any of the other documents in the module using the name of the document or putting it in parenthesis at the end of the sentence. The important thing is for me to understand what you are referring to, not for you to adhere to a particular citation method.
