Ethical Analysis of Business Scenarios
Choose two of the three cases below. Evaluate the selected cases and prepare ethical analyses following all the steps as outlined below. (You can consider the questions that follow the case(s).) Remember to analyse from 2 perspectives; this can be done in essay format or using the ethical analysis framework. Ensure to be detailed and thorough in your analysis. See more details in Ruggiero's chapters 7-10.
Ethical Analysis
1. Study the details of the case or scenario.
a. If you have all the details, note what circumstances, distinguish this case from similar ones. If you do not have all the details, obtain them. If they are unavailable, consider what they might be. (Ensure this section includes the following parts: 1) a summary of the case, 2) the issue being addressed, 3) what information is missing, 4) what questions can you ask? And 5) what sets this case apart from others/how similar is this case to others?
2. Identify the relevant criteria.
a. Consider any obligations that might exist among the individuals involved-for eg, contractual obligations, obligations of friendship or citizenship, business or professional obligations.
b. Consider relevant ideals, including prudence, justice, temperance, courage, loving kindness, honesty, compassion, forgiveness, repentance, reparation, gratitude, and beneficence.
c. Consider all significant consequences-direct and indirect; obvious and subtle; immediate and delayed; physical, emotional, and intellectual; intended and unintended-of the action on the person performing the act as well as on others.
3. Determine possible courses of action.
a. Identify the various alternative responses to the situation. Note that this step may require you to use your imagination.
4. Decide which is most ethical.
a. In light of your consideration of the criteria, decide which response is ethically preferable. If two responses produced good or two produce harm, choose the one that produces the greater good or the lesser harm.
5. What's the source of your decision?
a. Discuss the theory/theorist applied in the evaluation of the scenario
Case #1: Raiding Customer Assets at MF Global
Who Was Responsible?
Questions:
1. Did Corzine act appropriately? How would you characterize his behavior legally, ethically, and managerially? What other choices did he have?
2. Did Ms. O'Brien behave appropriately? Realistically, what other choices did she have?
3. Should the actions of either Corzine or O'Brien (or both or neither) be considered criminally negligent? Unethical? Bad judgment? Other?
4. What role should (or might have) the firm's Ethics and Compliance Officer played in this drama?
Case #2: Religion in the Work Space and Lunchroom
Questions for Discussion:
1. Is there an ethical issue in this case? If so, what is the main issue? Secondary issues? What is the rationale for your answer? Cite an ethical principle.
2. Should businesses and other non-religious organizations allow the overt practice of faith in the workplace?
3. Does it make any difference ethically or legally whether the business is publicly or privately owned?
4. What would you have done if you were the manager of these employees?
5. If you were the owner or head of an organization, what would be your policy for the expression of religious beliefs or practices in the workplace.
Case #3: Cultural Barriers: When Equality Compromises Efficiency
Should Mike make the decision to work only with English-speaking customers? Is that an ethical solution? Are there any alternatives?
