1. This chapter discusses the establishment of nationwide databases containing DNA samples. Do you believe that such a database is vulnerable to misuse by the government? For instance, what if insurance companies asked for access to these records to discover who had inheritable diseases and then refused coverage to those people because they were considered excessive risks? Is such a database a violation of privacy? Explain your answer.

2. Several studies show that eyewitness testimony is unreliable. Why then do prosecutors continue to use it and juries continue to expect it?

3. Do certain kinds of evidence carry greater weight than others? For instance, would you be more likely to believe a person over a photo- graph? What about a document over a photograph? If a witness testified differently from a videotape of the same incident, would you give the videotape more credibility? Would you trust the witness or your own interpretation of what happened on the videotape? Explain your answer.

4. At various times in the past decades, there have been calls to abolish the Exclusionary Rule. Give two reasons why abolishing this rule would be a good idea.

5. List and explain at least two reasons the Exclusionary Rule is a good idea and should be kept as originally mandated by the U.S. Supreme Court.
