Axcelle is a U.S. software company that provides accounting and financial tools and training software to small to medium size businesses. Axcelle is negotiating a licensing arrangement of the software to a large multinational organization, Sima in Japan. 

Part 1: International Law and Ethics

  1. Describe in your own words the essence of the course module International Law and Ethics.
  2. Include a reflection and response on the following questions:
    1. If management team of Axcelle and Sima got into a disagreement, what do you think would be some of the causes of the disagreement?
    2. Why do you think Axcelle and Sima would avoid the legal system and instead opt for alternative methods of dispute resolution?
    3. How can Axcelle protect its trade secrets from theft?
    4. What type of due diligence does Axcelle need to do to minimize licensing agreement risks?
  3. To strengthen Part 1, research and cite one case where a software company has entered into some ethical or legal issues while working with a partner in a different country.
    1. Identify a key learning from the case. What advice would you provide Axcelle based on this learning?

Part 2: Intercultural Competence for Market Entry

  1. Describe in your own words the essence of the course module Intercultural Competence for Market Entry.
  2. Describe the cultural differences between U.S. and Japan using the Hofstede model. Include a snapshot of the model with these countries and describe each of the elements unique to the countries.
  3. Identify one "Do" and one "Don't" for each of the following countries while conducting business with the people based out of the countries:
    1. U.S.
    2. Japan
  4. To strengthen Part 2, research and cite one case where an American company has entered business partnership with a Japanese company.
    1. What were some of the cultural issues that were raised during the partnership?
    2. Identify a key learning from the case. What advice would you provide Axcelle based on this learning?
