Under environmental protection legislation, it is indictable offence for a person to intentionally, recklessly, or negligently pollute the environment or causes or permits an environmental hazard which results in serious threats to the environment; a serious threat to public health; a substantial risk of serious damage to the environment; a substantial risk of a serious threat to public health or a nuisance.

States have environmental and planning legislation which specifies that certain industrial activities must be carried out with a pollution licence issued by the relevant environmental authority.

With respect to air pollution, discuss this issue and whether it is ever legal to allow emissions to be discharged into the atmosphere. Be sure to include relevant case law in your findings.
