The following employment scenario runs throughout the text. In each chapter numerous employment issues are raised. This is designed to present real-life issues that an employer would face. Tom Long and Mark Short have formed a business and named it "The Long and the Short of It" ("L&S"). L&S is a men's clothing store dedicated to large, tall, and short men. These are sizes not generally catered to by department stores and other men's clothing stores. Tom and Mark met while working at a well-known men's clothing store. Their idea for L&S stemmed from their experience of being unable to fulfill requests for clothing from very large, tall, or short customers. Niche marketing had intrigued both of them. They wanted to open their own clothing store and thought it was far better to specialize rather than attempt to be all things to all people. Fred Williams was hired by The Long and the Short of It 6 months ago. His position is market analyst. Fred's function is to anticipate fashion trends and to make purchase recommendations as to the type of clothing, the brand name, and the quantity. After analyzing the market, Fred creates his marketing plan. As it turns out, Fred is totally off the mark. Tom Long and Mark Short inform Fred that his work is unsatisfactory and, therefore, he is being discharged. Fred states he should not be judged on one mistake. He begs Tom and Mark to reconsider; otherwise, he will be forced to sue. Tom and Mark consult with Susan North, Esq., concerning their discharge of Fred. What advice should she give them?
