Padma entered into an employment agreement with Lindenwood Exteriors. The employment agreement contained an arbitration clause in which the Padma agreed that any disputes or claims that either Lindenwood or Padma may have as a result of their employment relationship would be resolved exclusively by arbitration. The employment agreement gave Lindenwood the authority to appoint the arbitrator for any arbitration proceeding. Padma sues Lindenwood for alleged violation of federal and state minimum wage laws. Lindenwood files a motion to dismiss the lawsuit claiming that Padma is required by the employment agreement to resolve her claim through arbitration.
