Question
Emil is stopped by the police for having an inoperable tail light. The police ask Emil if he has been drinking alcohol or taken any illegal drugs. He makes no oral reply but nods his head "yes". He has not been drinking alcohol and has not taken illegal drugs, but the police think he is acting funny so they administer some field sobriety tests on Emil. Emil suffers from a mental illness that can cause him to lapse into an irrational state of hearing voices. Unfortunately he had not taken his medicine for this mental illness. First he has to recite the alphabet backwards and he stumbles over a few letters. Next he has to walk about 20 feet in a straight line heel to toe and he looses his balance a few times. Lastly, he must close his eyes and touch the tip of his nose first with his right hand and then with his left hand. He does this successfully except he mixes up his left hand from his right hand. Based on Emil's tacit nod admission of drinking or drugs and this field testing the police arrest Emil for driving under the influence of alcohol/drugs. Before.
