2. A group of 4 friends enjoy music and like the same artists. They have gotten into the habit of exchanging their MP3 music files with the songs of their favorite artists.

Since they exchange the files among themselves for no money are they protected from being subject to copyright laws? Explain

One of them often buys music on a CD and then after downloading a copy on her hard drive, she gives the CD to one of her friends? Does this violate copyright law? Explain.

3. For purposes of the doctrine of respondeat superior, a court will review various factors to determine if enough of the factors are present to rule that the employee's act is within the scope of employment What are the eight (8) factors for determining whether an act is within the scope of employ­ment?

4. Paul is the owner of an apartment house in a district in which the boys constantly annoy the janitor and interfere with his work. Paul discharges one janitor who had punished a neighbor's boy for such in­ter­ference and directs Alex, the new janitor, to leave boys alone. Alex does not touch the boys but puts bro­ken glass at the place on the wall where boys customarily climb, in order to exclude them.

If a boy is injured on the glass while climbing without permission to be there, will Paul be liable for the janitor's actions under the theory of respondeat superior? What elements of the scope of employment are met? Explain your answer.
