Property Law Question
You are a lawyer for a local council and part of a team that is responsible for new, affordable housing, which is in critically short supply. You have been involved in informal discussions with a developer who hopes to construct several apartment buildings in your area. The 6 developer's team have sent you a sample of indicative by-laws they intend to use for their strata schemes. They include the following:
1. "All residents must be dressed appropriately on common property at all times and must not wear casual footwear (thongs/flip flops) or baseball caps on common property."
2. "No child may jump, run or play on a lot or common property after 9 pm at night". The head of the development team has said to you, "I know they're strict, but if people don't like them, they don't have to live in our schemes. They will be able to read the by-laws before they buy or rent".
Draft a memo explaining why you think the developer's team might want to reconsider:
• the legal validity and/or
• social desirability of the by-laws. (Do not address planning law in your answer.
