As was discussed in the lecture, the options in dealing with new threats are using to the full extent and/or potentially expanding existing executive powers, or the legislative branch creating new laws to either provide or reduce powers to the executive branch. These potential new laws created by Congress, and the use of executive powers are subject to judicial review by the U.S. Court system, and ultimately the Supreme Court of the United States to examine the consistency of laws and actions with the U.S. Constitution.
