Question: Because of the health emergency caused by the novel Coronavirus, COVID-19, Florida Governor Ron DeSantis issued Executive Order 20-94 addressing mortgage foreclosure and eviction relief. The order suspended for 45 days mortgage foreclosures from homes and evictions from residential tenancies caused by failure to pay mortgages and rents.

Section 3 of the Executive Order provides that "Nothing in this Executive Order shall be construed as relieving an individual from their obligation to make mortgage payments or rent payments." This order was extended through additional executive orders until October 1, 2020. DeSantis issued this order because of the extreme economic hardship caused by the Coronavirus pandemic. This order was challenged, however, by various property companies and financial institutions claiming that it violated Article I, Section 10 of the United States Constitution which provides, in part, that "No state shall...pass any law...impairing the obligation of contracts" The property companies and financial institutions claimed that, by allowing tenants and mortgage holders a moratorium on payments.
