Case: Homelessness is an issues that the State is grappling with. I think most people agree, we do not want to have people sleeping on our streets or in encampments on the side of the freeway. But how to deal with that is a topic of much controversy. The Governor has pushed for providing shelter to those that need it, while also clearing encampments. While the government can certainly offer people services and shelter, the reality is that if someone does not want to be housed, due to mental illness, drug addiction, etc, the law currently does not give the government the authority to force people into services or institutions, which can be considered a form of incarceration. There is discussion going on about changing that and the Governor is pushing a Care Court model, where people could be put into forced care via conservatorship if they fail to complete court mandated programs to get them out of homelessness. Opponents of such proposals contend this criminalizes homelessness and mental illness, that if you have mental illness which makes you comfortable with living in homelessness, this would be making it a crime to be mentally ill. However, most people do not want to see homelessness at the level we see it today.
