Gemma, a Filipino-Canadian, is a loan officer at a bank in Kitchener, Ontario. Her supervisor, Andy, often asks her if she "wouldn't mind" doing some extra reports because they are short staffed. She always smiles and says yes even though she is not paid extra for doing this work. After accepting the most recent extra assignments, she reviews her last two years on the job.
Nothing seems to be changing and she handles twice as many applications and reports as anyone else. Gemma is proud of her performance and knows that her supervisor counts on her to be quick and accurate and never refuse extra work. Last month there was an opportunity for a promotion in the department, with some supervisory responsibilities. Gemma, and her co-worker Bob, applied for the position. Andy conducted the two interviews himself and asked both Gemma and Bob to complete a written test. The next day, Andy made the promotion decision. Bob, a white male who had been in the department a year less than Gemma, got the job.
The day after she hears about Bob's promotion, Gemma goes to her supervisor and asks for feedback on why she did not receive the promotion. Andy tells her that although she is a valued member of the team, Bob has more leadership potential because his communication style is more in line with the company's corporate culture.
After this meeting, Gemma feels dejected and unmotivated. She quits her job within the month. The following day, Gemma contacts the Human Rights Tribunal to issue a complaint, claiming that she was discriminated against because her skills and experience were not being recognized.
