Buster Murdaugh, his living son, testified as a witness for his father's defense on February 21, 2023, stating his father said, "They did him so bad." Murdaugh (2023) indicated his father had phoned him around 20 minutes after when the prosecutors claimed the murders took place and that "his father sounded 'normal'." Alex made calls and texts to his wife and son while traveling to his mother's house.

According to the prosecution, they believe Alex went to his mother's house shortly after the murders to fabricate an alibi. It's also likely that he hid evidence there that hasn't yet been discovered. Based on the footage, call logs, and car position information. Using this evidence, the prosecution believes that Alex Murdaugh killed his wife and son in an attempt to gain sympathy after being confronted on the day of the killings about the money he stole. Alex Murdaugh claims that he was not at the kennels, where the murders occurred. Alex was seen on video that was taken by his son at the dog kennels minutes before Paul was killed.
