Chapter 10 discusses drug use/abuse among juveniles. We know drug abuse is connected to serious health risks, as well as delinquent acts, so, presumably, we have a strong societal interest in reducing juvenile drug use/abuse. On p. 160 of your text is a "case study" box focused on Vernonia School District v. Acton (1995), a U.S. Supreme Court case that arose from an Oregon matter. The book provides a quick summary of the case, but here is more, and more, info.
After considering this information about the case, as well as any additional info you may find, tell us:
1. Basically, in one or two sentences, what was the ruling of the Court, and how did the dissenting opinion by Justice O'Connor differ from the Court's ruling?
2. Do you agree with the Court, or the Dissent, or neither, in their application of the 4th Amendment here? Why?
3. What do you think more generally of drug testing in schools, as a student or parent or just a tax-paying citizen? Things to consider:
- Does school drug testing actually work to reduce drug use by students?
- Is there some approach to testing that you think would work (e.g. test everybody? test those suspected?)
- What are the potential downsides of testing?
- Is there something else we should be doing in schools to address youth drug involvement?
