Question: The federal government is concerned about the low literacy rates in some of its states. To address this issue, Congress decides to pass a law under the Taxing and Spending clause that involves a new tax on luxury goods, with the revenue generated from this tax to be used to fund literacy programs in the states with the lowest literacy rates. Congress also decides to offer additional funding to those states that agree to implement a new standardized curriculum designed to improve literacy rates.

State X is unhappy with this new policy and argues that education is a state matter, and that Congress is going beyond their authority by trying to influence state education policy through the use of tax revenue.
